1. General provisions
This document is an official public proposal (offer) of the individual entrepreneur Nesvitiy Mykola Anatoliyovych (hereinafter referred to as the "Seller") to conclude an agreement on providing access to the information and software product posted on the website www.kazkaland.com (hereinafter referred to as the "Site"). Payment for the product means full and unconditional acceptance of the terms of this offer (acceptance).
The buyer confirms that he is an adult and fully capable person and acts in his own interests or in the interests of the child as his legal representative (parents/guardian). The product is intended for use by a child under the supervision of a legal representative.
2. Subject of the contract
The Seller provides the Buyer with access to an information and software product - an interactive online product posted on the Site. The product is digital content that is provided electronically via the Internet.
3. Price and payment
The cost of the product is indicated on the relevant page of the Site in hryvnias. Payment is made online through the WayForPay payment service. Bank card data is processed exclusively by the payment provider in compliance with the PCI DSS security standard; The Seller does not store and does not have access to full card details.
4. Granting access
Access to the product is provided automatically immediately after successful payment - in the form of a personal link on the confirmation page, as well as by email to the Buyer's email address. The link is permanent.
5. Intellectual property rights
All product materials are subject to copyright and belong to the Seller. Access is provided for personal, non-commercial use. Copying, distribution, resale or transfer of access to third parties is prohibited.
6. Cancellation and refund
Since the product is digital content with instant access, the right to withdraw from the contract within 14 days does not apply after the start of access (in accordance with the legislation of Ukraine on consumer protection). By paying for the product, the Buyer agrees to immediate access and confirms that he loses the right to withdraw. More details on the page «"Return conditions"».
7. Responsibility
The Seller is not responsible for the inability to access the product for reasons beyond the Seller's control (lack of Internet, malfunction of the Buyer's device, etc.). The product is provided "as is".
8. Applicable law and dispute resolution
This Agreement shall be governed and construed in accordance with the laws of Ukraine. Disputes arising from this Agreement shall be resolved by the parties through negotiations, and in the event of failure to reach an agreement, in accordance with the procedure established by the laws of Ukraine.
